HIPAA-Compliant App Development: Requirements, Checklist and Costs

A HIPAA-compliant app protects electronic protected health information (ePHI) according to the HIPAA Privacy, Security and Breach Notification Rules. That means signing business associate agreements (BAAs) with every vendor that handles PHI, performing a risk analysis, and implementing administrative, physical and technical safeguards such as access controls, encryption, audit logging and breach response. HIPAA applies when your app creates, receives, stores or transmits PHI for or as a covered entity (healthcare providers, health plans, clearinghouses) or their business associates.

60 daysMaximum time to notify affected individuals after discovering a breach

Does Your App Need to Be HIPAA Compliant?

Ask these questions:

QuestionIf yes
Is your company a healthcare provider, health plan or clearinghouse? You're a covered entity; HIPAA applies
Do you build or operate the app for a covered entity, and handle PHI on its behalf? You're a business associate; HIPAA applies, and a BAA is required
Does the app exchange data with a provider's EHR on the provider's behalf?Likely a business associate
Is it a consumer app where users enter their own health data, with no covered-entity relationship?HIPAA usually does not apply, but other laws may (see below)

Other health data laws: the FTC Health Breach Notification Rule covers many health apps outside HIPAA, and state laws such as Washington's My Health My Data Act regulate consumer health data.

App exampleHIPAA usually applies?
Hospital patient portal appYes
Telehealth platform used by clinicsYes
Remote patient monitoring for a providerYes
Health plan member appYes
Consumer fitness or calorie trackerUsually no (FTC rules may apply)
Consumer app that lets users download their records via a patient-access APIOften no for the app itself; check carefully

HIPAA-Eligible Infrastructure and the BAA Rule

Major cloud providers, including AWS, Microsoft Azure and Google Cloud, sign BAAs and publish lists of HIPAA-eligible services. Only use the services covered by the BAA for PHI.

ComponentWhat to check
Cloud hosting & databasesA BAA is signed, and the service is on the eligible list
Email / SMS / push notificationsThe vendor signs a BAA, or you send no PHI through it
Video (telehealth)A BAA-covered video provider
Analytics & crash reportingConfigure to exclude PHI, or use a BAA-covered tool
AI / LLM APIsUse only enterprise offerings that sign BAAs; never send PHI to consumer AI tools
Customer support toolsA BAA, or strict PHI exclusion

Breach Notification Timeline

Who to notifyWhen
Affected individualsWithout unreasonable delay, and no later than 60 days after discovery
HHS (500+ individuals)Within 60 days of discovery
HHS (fewer than 500)Within 60 days after the end of the calendar year (annual log)
MediaWhen a breach affects more than 500 residents of a state or jurisdiction
Covered entity (if you're a business associate)Without unreasonable delay, and within 60 days of discovery (or sooner per the BAA)

Frequently Asked Questions

What makes an app HIPAA compliant?

An app is HIPAA compliant when it protects PHI according to the Privacy, Security and Breach Notification Rules: BAAs with vendors, a risk analysis, administrative, physical and technical safeguards such as access control, encryption and audit logs, and breach response procedures.

Does my health app need to be HIPAA compliant?

Your app needs HIPAA compliance if you're a covered entity, such as a provider or health plan, or a business associate handling PHI on a covered entity's behalf. Consumer health apps without that relationship usually aren't covered by HIPAA but may fall under the FTC Health Breach Notification Rule or state health data laws.

What is PHI?

PHI (protected health information) is individually identifiable health information, such as diagnoses, treatments, test results or payments for care, linked to identifiers such as names, dates, contact details, record numbers or device IDs.

What is a business associate agreement (BAA)?

A BAA is a contract between a covered entity and a business associate, or between a business associate and its subcontractor, that requires the vendor to safeguard PHI and comply with HIPAA requirements.

Is AWS, Azure or Google Cloud HIPAA compliant?

AWS, Microsoft Azure and Google Cloud sign BAAs and offer HIPAA-eligible services, but your app is only compliant if you use eligible services, configure them securely and meet all other HIPAA requirements.

Does HIPAA require encryption?

Under the current Security Rule, encryption is an "addressable" specification, but in practice it's expected. HHS proposed in December 2024 to make encryption of ePHI required. Encrypting PHI in transit and at rest is the standard approach.

How much does it cost to build a HIPAA-compliant app?

A HIPAA-compliant MVP typically costs $50,000–$100,000. Telehealth platforms cost $80,000–$150,000 or more, and EHR-integrated enterprise platforms $150,000 or more. Compliance usually adds about 15–25% compared with a non-HIPAA equivalent.

What are the penalties for HIPAA violations?

HHS's Office for Civil Rights can impose tiered civil monetary penalties per violation, adjusted annually for inflation, with higher tiers for willful neglect. Criminal penalties apply in some cases, and state attorneys general can also take action.

Can I use ChatGPT or other AI tools with patient data?

Only if the AI vendor signs a BAA and the specific service is covered. Consumer AI tools generally shouldn't receive PHI. Use enterprise offerings with BAAs, or de-identify data first.

How soon must a HIPAA breach be reported?

Affected individuals must be notified without unreasonable delay and within 60 days of discovery. Breaches affecting 500 or more people must also be reported to HHS within 60 days, and to the media when more than 500 residents of a state are affected.
